Apex Consistency Rule in 2026: The 50% Rule on New PA Accounts

Written and fact-checked by the Funded Futures Family team against the firm’s published help center. Last reviewed September 4, 2026.

Apex Trader Funding applies a 50% consistency rule on Performance Accounts purchased on or after March 1, 2026: your largest profitable day must be below 50% of net profit since your last approved payout, or the payout button stays unavailable. Evaluations have no consistency rule. Legacy Performance Accounts from before that date use the older 30% rule. Current as of September 4, 2026.

How the Apex consistency rule works

Apex’s homepage banner sums it up: “50% Consistency” and “NO Eval consistency rules.” You can pass the evaluation with a single big day. Source: apextraderfunding.com.

Once funded, Apex’s help center defines the rule this way: “The 50% Consistency ensures that no single trading day accounts for more than 50% of your total accumulated profit at the time of a payout request. This applies to profits earned since your last approved payout, or since account inception if no payout has been made.” The formula is Highest Profit Day divided by Total Profit, and “The result must be below 50%.” Apex’s shortcut for the profit you need is Highest Profit Day divided by 0.5. Two details are easy to miss. Losing days count in the denominator: Apex’s example is a $1,000 day against $800 net profit, which works out to 125%. And the rule is strict. A day that is exactly 50% of profit does not qualify.

Product generationEvaluationPerformance AccountWhen it ends
New (bought on or after 3/1/2026)No consistency ruleLargest day below 50% of net profit since last payoutApplies for the life of the PA
Legacy (before 3/1/2026)No consistency ruleLargest day no more than 30% of profit balanceAfter the sixth payout or live transfer

What happens if you break it

Nothing is lost. Apex’s FAQ asks “Do I fail if I am above 50% consistency?” and answers “No.” The account stays active and “you may continue trading until the percentage falls below 50%.” The payout request option is simply unavailable until then.

Worked example on a 50K account with $3,000 profit

On a new 50K Performance Account, the largest day you can hold and still request a payout is just under $1,500, say $1,499. A $1,500 day is exactly 50% and fails the “below” test. An $1,800 day would need net profit above $3,600. Consistency is one gate among several: on the 50K EOD product you also need a balance of at least $52,600 and five days of $250 or more. On a legacy 50K Performance Account under the 30% rule, the largest day allowed is $900; a $1,500 day would need $5,000 in profit. Source: Legacy PA payout parameters.

What changed

March 1, 2026 is the dividing line. Products bought on or after that date use the 50% rule for the life of the Performance Account. Legacy products use the 30% rule, which Apex says applies “until the sixth payout or until the account is transferred to a Live Prop Trading Account.” The newer rule is looser per payout and lasts longer; the older rule is tighter and eventually goes away. Legacy compliance text also warns that “blatant or repeated” windfall violations can forfeit payout requests. New-product pages carry no equivalent language.

Firms that do not have this rule

Funded Futures Family’s Premier+ with Fast Pass has no consistency rule on the evaluation and can be passed in 1 day; funded accounts bought from September 9, 2026 carry a 40% rule. The trade-off is price and payout sizing: $114 or $144 per month on a 25K versus $89 or $119 for Standard Premier+ (which keeps a 50% eval-only rule), and payouts capped at 50% of profit per request, up to $1,000 on a 25K. Prime at $129 per month has no evaluation rule and a 40% funded rule whose calculation resets after each approved payout. See the Premier+ plan page and the FFF rules explainer.

Frequently asked questions

Is the Apex consistency rule 30% or 50%?

It depends on when you bought the product. Performance Accounts tied to evaluations purchased on or after March 1, 2026 use the 50% rule: your largest day must be strictly below half of net profit since the last approved payout. Legacy accounts from before that date use the 30% rule, where no single day may exceed 30% of the profit balance at a payout request. Many older articles still quote 30% without noting the split, so check your account generation in your Apex dashboard.

Does the Apex consistency rule apply during the evaluation?

No. Apex advertises “NO Eval consistency rules” on its homepage, and the 50% requirement page ties the rule to the Performance Account and to payout requests. You can pass an evaluation with one large day. The rule begins once you are funded and applies to profit accumulated between payouts. Because it resets after each approved payout, a big day early in a new cycle means building more profit in that cycle before the next request.

What if my biggest day is exactly 50% of my profit?

It does not qualify. Apex’s wording is “The result must be below 50%,” and its EOD payouts page says “No single profitable trading day may account for 50% or more of total profit earned since your last approved payout.” A $1,500 day on $3,000 of net profit is 50.0% and would block the payout button. Net profit above $3,000, even by a small amount, brings the ratio under the line. The account is never at risk; the only effect is timing.
